Most people never expect to be involved in a serious car accident. Yet every day across Arizona, drivers and passengers find themselves suddenly navigating injuries, medical bills, insurance claims and uncertainty about what comes next.
As a personal injury attorney, I often meet people who made critical decisions in the hours and days after a crash without fully understanding their rights. Unfortunately, those mistakes can affect both their recovery and their financial future.
One of the biggest misconceptions I encounter is the belief that insurance companies are there to take care of everything. While insurance plays an important role in helping people recover after an accident, it is important to remember that insurance companies are businesses. Their interests are not always aligned with yours.
Many accident victims are surprised to learn that medical providers still expect payment while a claim is being resolved. Waiting for a settlement does not stop bills from arriving. In some cases, unpaid medical expenses can even affect a person’s credit. That is why it is often important to use available health insurance while pursuing a claim.
Another common mistake is speaking too freely with insurance adjusters immediately after a collision. Shortly after an accident, an insurance company may contact an injured person seeking information, a recorded statement or even an early settlement. At that stage, however, most people do not know the full extent of their injuries. A sore neck today could become weeks or months of treatment tomorrow.
Too often, accident victims feel pressured to settle before they understand what their recovery will actually involve. Once a claim is resolved, there are no second chances to seek additional compensation for medical treatment that becomes necessary later.
Arizona residents should also understand that they do not have to rush through the process simply because an insurance company wants a quick resolution. Your first priority should be your health. That means seeking appropriate medical care, following your doctor’s recommendations, and giving yourself the time necessary to heal.
There is another important lesson I wish more people understood: not every injury is immediately obvious.
Adrenaline can mask pain after a collision. Some people walk away believing they are fine, only to experience symptoms days or weeks later. Seeking medical attention after an accident is not only about documentation; it is about making sure you receive the care you need.
I also encourage people to involve law enforcement whenever possible. Police reports often provide critical evidence, identify witnesses, and establish details that may become important later. Witnesses can make the difference between proving what happened and being left with one person’s word against another’s.
Many drivers are also unaware of Arizona’s comparative negligence law. Some people assume they have no claim if they share any responsibility for a crash. That is not necessarily true. Arizona law allows injured individuals to pursue compensation even when they are partially at fault, although any recovery may be reduced according to their share of responsibility.
Finally, there is one step Arizonans can take before they ever find themselves in an accident: review their insurance coverage.
Too many drivers discover after a crash that the at-fault motorist has little or no insurance. Uninsured and underinsured motorist coverage can provide a financial safety net when the other driver lacks adequate coverage. It is one of the most important protections available, yet many people do not fully understand its value until it is too late.
Knowing your rights after an accident is more than pursuing a legal claim. It is about protecting your health, preserving your financial stability, and making informed decisions during a stressful time.
No one plans to be injured in a crash. But if it happens, understanding your rights can make all the difference between being overwhelmed by the process and confidently navigating the road to recovery.
