Leon Law offers an explanation of the legal implication of rear-end collisions

If you drive an automobile in any American metropolitan area you are certain to, at one time or another, get into a motor-vehicle accident — with the Phoenix metropolitan area certainly no exception.
“The most common type of car accident is a rear-end collision,” said Jose Leon, founder of Leon Law. “These happen all the time in our roadways. The interesting thing about the rear-end collision is that it is commonly misconstrued as the simplest of claims —- that a rear-end collision should be open-and-shut and should be resolved easily and fairly.”
Mr. Leon warns the devil is and always will be found in the details — especially during the proceedings of an injury motor-vehicle accident.
“The problem can be that the manner in which the accident occurs can change the dynamics of whether you get a claim paid or not,” he said. “There are times that there are multiple cars involved in a chain reaction of rear end collisions. You can have multiple people in the vehicles. Or, you can have a hazard on the road that forces someone to stop abruptly.”
When it comes to claims being paid, Mr. Leon suggests a holistic view of the process as the details of the case will dictate how the claim unfolds between claimant and insurance carrier.
“These can create a risk that an insurance company may either deny or limit the amount of money we can recover even if we have injury, treatment, and bills that arise out of a rear-end collision,” he said. “You will want an attorney to get involved early so that if these things happen that you don’t get an unfair settlement when the insurance company handles your claim.”
Mr. Leon explains the most challenging part of recovery is that each person heals differently — and can be affected by injuries sustained dramatically different.
“The human body is so unique that a car accident doesn’t net the same injuries to people even if they are in the same vehicle when the accident occurs,” he said.
“Our age, location in the vehicle, and prior medical history can impact how our bodies deal with the forces associated with the car accident. So even though we may have common areas that get affected we may end up with a widely different treatment plan and treatment lengths as we get our body back to healthy.”
