*Can you give readers some idea of the things that you look for when you are evaluating a personal injury case?
One of the most important things you look for in a case is whether the person is injured and requires treatment. That is the initial trigger to identify whether you need an attorney or not. If that happens you will benefit tremendously from the guidance and will have a better financial outcome in the end as well.
*What are some of the most common types of cases that you handle at Leon Law?
The most common type of case is a car accident. From there we have accidents between cars and pedestrians, cars and semi-trucks, and cars against electric scooters or electric bikes.
*Would you mind providing an outline of the process of filing a personal injury lawsuit and at what level are you involved with clients?
One of my experiences that helps to translate to our personal service is that I speak Spanish as my native tongue. Injured people that speak Spanish as their first language want to feel comfortable with the process and get their questions answered. When an accident happens, we automatically have an opportunity to present a claim against an insurance company for either property damage, bodily injury, or both.
Even though a lot of folks think it starts with opening a claim, the actual start of the claim is the documentation of what happened at the scene.
Then they should seek medical attention to address injuries (if any) so that there is a timely connection of the injuries to the events that caused them. A person typically has two years to present a claim so even though we think there is urgency it can wait. Once we know that there is no emergency on the injuries, and one is stable, we can then contact an attorney to discuss how to move forward with the claim in a responsible manner.
*What are some of the things you tell clients they can expect during the course of a personal injury lawsuit?
The expectation for the client should be their focus and attention on their treatment. Our goal is to make it seamless and protect them from any tactics an insurance company may want to employ to reduce the amount of money the injured person receives for the value of their personal injury or property damage claim(s).
*From a position of advice, what are some of the things that you, as the victim, can do to prepare for a personal injury trial?
The best thing that one can do to prepare for a personal injury case or trial is to have a good attorney that provides them with the appropriate advice and making sure they are prepared for each step of the claims process or trial.
*What advice would you give to someone who is considering hiring a personal injury lawyer?
I would say that the sooner you call an attorney the better. We can provide a lot of helpful advice to people who are injured from the beginning. A person can start making decisions that will reduce the value of their claim or reduce the amount they receive in their pocket.
*What are some new and emerging challenges in personal injury law?
The current challenges we see in personal injury claims have to do with a client’s ability to depend on their own insurance to help in the personal injury claim process. We are now having our own insurance companies scrutinizing the claim and ultimately minimizing the ability of full recovery from the process.
